Lizzie Smith Photography is a small business aiming to capture lasting memories for all clientele. Personal promotional material is a required asset in order to reach more audiences and grow as a business. By filling out this form, you are agreeing to allow full use of any photos or videos taken during your session to Lizzie Smith Photography, which may or may not be used for business or personal matters. By filling out this form, you acknowledge that Lizzie Smith is the creator, and therefore owns the rights to every image and video captured and edited.
**I hereby agree to allow Lizzie Smith Photography to use any and all photos and videos from our session together for any promotional material, website content, art exhibits and contests, published work, social media, and business or personal use, thus, giving Lizzie Smith Photography full access and liberty to all photos and videos taken during my session with her. Photography is a form of art, and every photographer has their own unique style of capturing and editing photos. The editing style that Lizzie Smith Photography produces is unique and has taken many long years to achieve. Thus, tampering with any edited photos, further editing, manipulating, or placing any kind of filters over any photos taken by Lizzie is in direct violation of Lizzie Smith Photography. You are choosing Lizzie Smith Photography to capture your photos because you enjoy the aesthetic and unique look produced. If you wish to have a different look for your photos, you will need to find another photographer. **I hereby agree to NEVER tamper with, further edit, manipulate, or place any sort of filters on any photos taken by Lizzie Smith Photography. I understand that I am choosing Lizzie Smith Photography to capture and edit my photos because I enjoy the style produced by Lizzie. Tagging and giving credit to creators on social media is one of the best ways for small businesses to reach more clients. By filling out this form, you are agreeing to give full credit to Lizzie Smith Photography and agreeing to tag @lizziesmithphoto on every photo you choose to post to social media. For any printed announcements using photos captured and edited by Lizzie Smith Photography, such as senior photos, family Christmas cards, etc., giving credit to Lizzie Smith Photography is not required, but is highly preferred as it helps to reach more clients, especially to those who may not have social media. **I hereby agree to always tag @lizziesmithphoto to ALL photos taken by Lizzie Smith Photography on ALL of my social media platforms. I agree to give full credit to Lizzie Smith Photography for any photos she has captured and edited. |

Photography Payment Terms for Lizzie Smith Photography
1. Retainer Fee and Booking:
Before every photoshoot with Lizzie Smith Photography, a non-refundable retainer fee of $100 is required to secure your photography session. This payment must be completed within 48 hours of signing this Photography Payment Contract. If you are unable to pay the $100 fee within this 48-hour window, please contact Lizzie Smith Photography directly via email at lizzie@lizziesmithphoto.com or by text at (801) 850-8213 to discuss alternative payment arrangements.
2. Payment Schedule:
The $100 retainer fee serves as a non-refundable deposit toward the full payment of your session (see the full price list for details). The remaining balance, after the $100 non-refundable retainer fee, is due by 11:59 PM, five days after your photoshoot session, unless a prior arrangement has been made with Lizzie Smith Photography.
3. Late Payment Fees:
If the remaining balance is not paid within this 5-day period and no accommodation has been arranged, a late fee of $50 per day will be applied for each day the payment is overdue. Failure to pay the outstanding balance and any accrued late fees within 14 days may result in the cancellation of receiving your photos and forfeiture of the retainer fee.
4. Cancellation and Rescheduling Policy:
In the event that you need to cancel or reschedule your session, please notify Lizzie Smith Photography at least 72 hours in advance. Cancellations made less than 72 hours before the scheduled session will result in the forfeiture of the retainer fee. Rescheduling is subject to availability.
5. Session Details and Preparation:
Clients are responsible for arriving on time and prepared for their photography session. Any delays caused by the client may result in a shortened session time. Lizzie Smith Photography will provide a consultation prior to the session to discuss themes, locations, and any specific requests. If Lizzie Smith Photography is more than 10 minutes late to the photoshoot, a 25% discount will be applied to your total session fee.
6. Delivery of Final Products:
Edited digital images will be delivered within 2-4 weeks after the photoshoot session, depending on the scope of the project. Physical products, such as prints or albums, may require additional time for delivery. All final products will be delivered electronically unless otherwise specified and agreed upon.
7. Copyright and Usage:
All images and content created by Lizzie Smith Photography remain the intellectual property of Lizzie Smith Photography. Clients receive a personal-use license for the images and may not sell or distribute them for commercial purposes without prior written consent. Lizzie Smith Photography reserves the right to use the images for portfolio, marketing, and promotional purposes.
8. Liability:
Lizzie Smith Photography will take all reasonable precautions to ensure the safety and satisfaction of the clients during the photoshoot session. However, Lizzie Smith Photography is not liable for any injuries, losses, or damages incurred during the session. Clients agree not to hold Lizzie Smith Photography responsible for any claims arising from the session, except in cases of gross negligence or willful misconduct.
9. Agreement and Acknowledgement:
By signing this Photography Payment Contract, you acknowledge that you have read, understood, and agree to the terms and conditions outlined above. This agreement constitutes the entire understanding between the client and Lizzie Smith Photography and supersedes any prior agreements.
